The condominium version of California's exterior elevated element inspection differs from the apartment version in four ways that change how the report is written: it is governed by Civil Code section 5551 rather than Health & Safety Code 17973, it must be performed by a licensed structural or civil engineer or architect, it is inspected on a random and statistically significant sample rather than on a flat percentage, and its findings feed the association's reserve study.
The sampling difference is the one that catches people who have written the apartment report first. Section 5551(b)(1) requires a visual inspection of "a random and statistically significant sample of exterior elevated elements", and 5551(a)(4) defines the term numerically: "a sufficient number of units inspected to provide 95 percent confidence that the results from the sample are reflective of the whole, with a margin of error of no greater than plus or minus 5 percent." There is no 15 percent in this section — that figure belongs to Health & Safety Code 17973 and does not carry across. Sections 5551(c), (d) and (h) then set out the mechanism: before the first inspection the inspector generates a random list of the locations of each type of element for which the association has maintenance or repair responsibility, gives it to the association, inspects in accordance with it, and each subsequent inspection commences with the next element on that list and proceeds in order.
That last point about the reserve study is the one most reports handle badly. A report written only as a safety document gives the board a hazard list; a report written with the reserve study in mind gives them the same hazard list plus the remaining-life information their reserve preparer actually needs — and section 5551(f) requires the report to be incorporated into the study required by Civil Code 5550, so this is not an optional courtesy.
The worked example below is written for a board audience without becoming vague — it states the same findings an engineer would state to another engineer, and then says what each means for the association's funding plan over the next nine years.
Jurisdiction
Written primarily against US practice: the ASTM E2018 baseline, agency scopes such as Fannie Mae Form 4099, and — where a page says so explicitly — California statute. Client scope governs any individual engagement and may expand or reduce what is described here. State and local inspection obligations differ, and licensure requirements for the work described vary by state. Outside the US, treat the structure as transferable and the standards and statutes as not.

When to use this document
- Inspecting exterior elevated elements at a California condominium project. Since SB 410 (Chapter 516, Statutes of 2025), section 5551(l) applies only to buildings containing three or more ATTACHED multifamily dwelling units — the word 'attached' was added and narrows the scope.
- You are a licensed structural or civil engineer or architect. The civil engineer route was added by AB 2114, Chapter 100, Statutes of 2024; before that the section named only structural engineers and architects. The contractor and certified-building-inspector routes available under the apartment statute are not available here.
- The elements in question are ones for which the association has maintenance or repair responsibility. Section 5551(b)(1) draws the scope on that boundary, which makes the governing documents part of the scope determination rather than a courtesy note — and it is the population the random list and the sample are both built from.
- When the association needs the inspection result integrated into its reserve study rather than delivered as a standalone safety memo.
- For apartment buildings and anything else that is not a common interest development, use the Health & Safety Code 17973 template instead.
Worked example
Fictional. Marisol Terrace Owners Association, a 42-unit condominium project in three four-storey buildings, 900 Alcazar Drive, San Diego, California, built 2004. Forty-two balconies and six exterior stair systems. Inspected 6 and 7 April 2026 by K. Adeyemi, licensed structural engineer — the association's first inspection under Civil Code 5551, completed after the 1 January 2025 statutory deadline, on a nine-year cycle with the association's reserve study update due in the same year. Dates, quantities, service lives and the sample derivation below are illustrative for this fictional project and are not values to reuse.
Association and Inspection Details
Marisol Terrace Owners Association, 900 Alcazar Drive, San Diego, California. Forty-two residential condominium units in three four-storey wood-frame buildings over a podium slab, constructed 2004. This inspection was performed under California Civil Code section 5551, which requires inspection of exterior elevated elements at condominium projects containing three or more attached multifamily dwelling units. Inspection dates: 6 and 7 April 2026. Inspector: K. Adeyemi, licensed structural engineer, California licence S-XXXX. This report is provided to the association's board of directors and its managing agent, Coastline Community Management.
This is the association's first inspection under Civil Code 5551. Section 5551(i) required it to be completed by 1 January 2025, and it was not — the board commissioned it in February 2026 following a change of managing agent. That is recorded here rather than left out, because the date of inspection is one of the items section 5551(e)(5)(A) requires on the first page and because the next inspection is due nine years from this one. Note also that the deadline extension granted by AB 2579 applied to the apartment statute, Health & Safety Code 17973, and not to this section; the condominium deadline was never extended.
The Random List and the Statistically Significant Sample
Population. Forty-two balconies, one serving each unit, of two types: 30 are cantilevered wood-framed balconies at buildings 1 and 2, and 12 are podium-level terraces at building 3 constructed over occupied space. Six exterior stair systems with landings serve the three buildings. The 12 podium terraces are concrete over the podium slab, have no wood-based load-bearing components, and are therefore not exterior elevated elements within the meaning of Civil Code 5551; they were nonetheless walked and are commented on separately, because the board will ask and because their waterproofing failures affect the units below. Population within scope: 30 wood-framed balconies and 6 stair systems, 36 elements in two types.
Sample size. Section 5551(b)(1) requires a random and statistically significant sample, and section 5551(a)(4) defines that as a sufficient number of units to give 95 percent confidence with a margin of error no greater than plus or minus 5 percent. The section states the confidence and the margin but prescribes no formula, so the derivation used is stated here for the board to check. Taking the conventional proportion estimate at 95 percent confidence and a 5 percent margin, and applying a finite population correction against these small populations, the required sample is 28 of the 30 balconies and 6 of the 6 stair systems. Small populations behave this way: at a 42-unit project the statutory confidence and margin drive the sample to very nearly a census, which is why sampling saves an inspector far less here than it would at a 400-unit project.
Elements inspected: all 30 wood-framed balconies and all 6 stair systems — 36 of 36, exceeding the derived sample of 28 and 6.
The random list. As required by section 5551(c) and (d), a random list of the locations of each type of exterior elevated element for which the association has maintenance or repair responsibility was generated before the inspection, covering all 36 elements, and was provided to the association on 3 April 2026. It is reproduced at Appendix D and should be retained by the association: under section 5551(h) each subsequent inspection commences with the next element on that list and proceeds in order through it. Because this inspection covered the full list, the inspection due nine years from now commences at the head of the list, at element B1-201.
Method: visual inspection of all accessible surfaces; probing of exposed framing with an awl at every element; moisture meter readings at the balcony-to-wall interface of all 30 balconies; and invasive openings at three balconies selected from the visual and moisture findings — units 1-402, 2-301 and 2-104 — each approximately 12 by 12 inches through the soffit, made and closed on 7 April 2026.
Maintenance responsibility: the association's CC&Rs, article VII section 3, assign the structural components and waterproofing of balconies to the association, and the surface finish and the owner's personal property to the unit owner. This report addresses association-maintained components, which is the scope section 5551(b)(1) sets. Where a finding concerns an owner-maintained element — for example, a planter placed on a balcony deck that traps moisture against the coating — it is identified as such, because the remedy is a notice to the owner rather than an association contract.
Photographs and Testing
One hundred and thirty-one photographs, indexed at Appendix A and keyed to unit-based element identifiers. Every element within scope carries an overall photograph, a walking-surface photograph and a photograph of the wall interface; elements with findings carry additional photographs with a scale in frame.
Moisture readings, pin-type meter, all 30 wood-framed balconies, 6 April 2026, ambient 61°F, clear, no precipitation for eleven days. Recorded at Appendix B. Twenty-three balconies read between 8 and 13 percent. Four read between 15 and 19 percent (units 1-201, 1-301, 2-202, 2-401). Three read above 20 percent: 1-402 at 26 percent, 2-301 at 22 percent, 2-104 at 21 percent.
Invasive openings, 7 April 2026, Appendix C. Unit 1-402: framing sound; sheathing stained across the opened area; ledger flashing present but terminated short of the wall covering, permitting water behind it. Unit 2-301: framing sound; staining at the joist ends; flashing present and correctly lapped, with the water source appearing to be the failed coating at the wall interface rather than the flashing. Unit 2-104: incipient decay at the outer 4 inches of two joists, surface only, with sound wood beneath on probing; flashing present.
Load-Bearing Components and Waterproofing System
This section identifies the components, as required by Civil Code section 5551(e)(1). Condition follows in the next section.
Wood-framed balconies, buildings 1 and 2 (30 elements). Load-bearing components: cantilevered 2x10 wood joists extending from the building floor framing at approximately 16 inches on centre, plywood sheathing over the joists, and a plywood soffit below. There is no exterior post or beam support; the load path is entirely the cantilever and its connection into the floor framing at the ledger line. Associated waterproofing system: a fluid-applied elastomeric traffic coating over the plywood deck, turned up at the wall interface and terminated beneath the wall covering, with sheet metal flashing at the ledger line. Guardrails: aluminium assemblies mechanically fastened through the deck, so each fastener is a penetration through the waterproofing. Components were identified by direct observation, by the three invasive openings described above, and against the architectural and structural drawings held by the association.
Exterior stairs (6 systems). Load-bearing components: sawn wood stringers bearing on concrete pads at grade and on wood-framed landings at each level, with wood treads. Associated waterproofing system: paint and coating on the stringers and landings, and coating at the stringer base where it meets the concrete. Guardrails: aluminium, fastened to the stringers.
Podium terraces, building 3 (12 elements). Structural slab of concrete over occupied space with a fluid-applied traffic membrane. These have no wood-based load-bearing components and are therefore not exterior elevated elements within the meaning of Civil Code 5551; they are identified here and reported separately for the board's information only.
Current Physical Condition, Including Immediate Threat
No exterior elevated element at this property presents an immediate threat to the health and safety of the residents. That statement is made under Civil Code section 5551(e)(2) and applies to all 30 wood-framed balconies and all 6 stair systems inspected. No guardrail was found loose under hand pressure, no element exhibited movement under load, and the only decay found was incipient and surface-level at two joist ends at unit 2-104. The detail of each element follows.
Wood-framed balconies, buildings 1 and 2 (30 elements). Condition: the traffic coating is at approximately 22 years of service with no documented recoat, and the association's records show only spot repairs in 2016 and 2021. Twenty-three balconies exhibit coating in serviceable condition with wear at traffic paths and minor cracking at the wall interface. Seven exhibit coating failure at the wall interface, ranging from hairline separation to open gaps of up to 1/4 inch at units 1-402, 2-301 and 2-104. Guardrail fastener penetrations through the coating are a systematic detail weakness across all 30: at 11 balconies the sealant at those penetrations has failed and water can enter at the fastener. No guardrail was loose under hand pressure at any of the 30.
The three balconies with openings are described above. Of these, unit 2-104 shows the only decay found: incipient, at the outer 4 inches of two joists, surface only. That is a maintenance-stage finding rather than a structural one, and it is significant chiefly because it shows what the other elevated-moisture balconies will look like if the coating is not renewed.
Exterior stairs (6 systems). Stringers sound on probing at all six. Coating at the stringer base has failed at systems serving buildings 1 and 3, exposing wood at grade contact. Treads sound; nosings worn at the two systems serving building 2. No system exhibits movement under load.
Podium terraces, building 3 (12 elements, outside statutory scope, reported for the board). The membrane exhibits blistering across an estimated 15 percent of the total terrace area and open seams at four locations. Three units on the level below (3-101, 3-104, 3-107) report water intrusion, and staining was observed at the ceilings of two of them. This is not an exterior elevated element within the meaning of Civil Code 5551, and it is the most active water problem at the property.
Expected Future Performance and Remaining Useful Life
This section answers Civil Code section 5551(e)(3) and is written so the association's reserve study can consume it directly. The service lives given are this inspector's professional projections for these assemblies in this exposure, not published figures. Waterproofing systems and structural components are stated separately, because they sit on different cycles and funding one in place of the other is the most common reserve error in this building type.
Balcony traffic coating (30 elements, association-maintained): remaining useful life 0 to 2 years. The system is at approximately 22 years against an assumed 10 to 15 year service life for an elastomeric traffic coating in this exposure — an assumption stated so the board can challenge it, not a published value — and it is failing at the wall interface at seven elements. Full recoat, including detailing at the wall interface and at all guardrail penetrations, is the single highest-value expenditure available to this association. Expected performance if recoated within 2 years: 12 to 15 years to the next recoat, with the balcony structures protected throughout. Expected performance if not recoated: progressive water entry at the failed interfaces, with decay of the kind found in incipient form at unit 2-104 becoming likely at the elevated-moisture balconies within 3 to 5 years, and structural repair costs an order of magnitude above the recoat.
Balcony structures (30 elements): remaining useful life in excess of 25 years, conditional on the coating being renewed and maintained. No element requires structural repair at this inspection other than the two joist ends at unit 2-104, which should be addressed within the recoat scope.
Guardrails (30 elements): remaining useful life 15 to 20 years for the aluminium assemblies. The sealant at fastener penetrations is a maintenance item on a 5 to 7 year cycle, not a reserve component, and it has been missed.
Exterior stairs (6 systems): remaining useful life 12 to 18 years for the stringers, conditional on restoring the coating at grade contact within 12 months. Treads and nosings: 8 to 10 years.
Podium terrace membrane (building 3, outside statutory scope): remaining useful life 0 years. The membrane is failing and is causing water intrusion into occupied units now.
Recommendations for Repair or Replacement
1. Recoat all 30 balcony traffic coatings, with correct detailing at the wall interface and sealing at all guardrail fastener penetrations, and repair the two joist ends at unit 2-104 within that scope. Urgency: within 12 to 24 months. This is the item that protects everything else.
2. Replace the podium terrace membrane at building 3 and repair the resulting damage in the three units below. Urgency: within 12 months. Outside the statutory scope of this inspection but the most active water problem at the property.
3. Restore coating at the stair stringer bases at buildings 1 and 3. Urgency: within 12 months. Small cost, and the difference between a 12-year stair and a 25-year one.
4. Establish a sealant maintenance cycle at guardrail penetrations, 5 to 7 years, as an operating item rather than a reserve item.
5. Re-inspect the four balconies reading 15 to 19 percent (units 1-201, 1-301, 2-202, 2-401) at the time of recoat, when the substrate is exposed and observation costs nothing.
Costing was not within the scope of this engagement. The association should obtain competitive proposals for items 1 and 2, and should expect item 1 to be the larger of the two.
First-Page Disclosures and Inspector Certification
The following appears on the first page of the issued report, as required by Civil Code section 5551(e)(5). It is reproduced here in the order the subdivision sets out.
(A) Date of inspection: 6 and 7 April 2026.
(B) Total number of units in the condominium project: 42.
(C) Total number of units with exterior elevated elements: 30. The figure is given on the balcony basis — the 12 building 3 units served by podium terraces are excluded because those terraces are not exterior elevated elements within the meaning of the section. All 42 units are served by one of the six stair systems, so a stair-inclusive reading of this item would give 42. The section does not say which basis to use; the basis used is stated so the reader is not left to guess.
(D) Total number of exterior elevated elements in the project: 36 — 30 wood-framed balconies and 6 exterior stair systems with landings.
(E) Total number of exterior elevated elements inspected: 36.
(F) As of the date of inspection, the total number of inspected exterior elevated elements identified as posing an immediate threat to the safety of occupants: 0. Number of units impacted: 0.
(G) Certification: the undersigned inspector conducted a visual inspection and evaluated a statistically significant sample of the exterior elevated elements within this condominium project, as required by Civil Code section 5551(b). The sample derivation, the random list and the elements inspected are set out in this report and at Appendix D. K. Adeyemi, licensed structural engineer, California licence S-XXXX.
Delivery, and Emergency Measures Where a Threat Is Found
No element was found to present an immediate threat to the health and safety of the residents, so the emergency machinery at Civil Code section 5551(g)(1) — copy to the association immediately upon completion of the report, copy to the local code enforcement agency within 15 days of completion of the report, and immediate preventive measures by the association including preventing occupant access until repairs are inspected and approved — is not engaged by this report. It is set out here so the board knows what would have followed had the answer been different. Preventing occupant access is not necessary at any element, and emergency repairs including shoring are not necessary at any element.
Delivery. Civil Code section 5551(f) requires the report to be stamped or signed by the inspector and presented to the board; it sets no number of days for a routine report, and none is implied here. This report was completed on 24 April 2026, stamped and signed, and presented to the board of directors and to Coastline Community Management on 27 April 2026. There is no routine filing with a local code enforcement agency under this section, though the City of San Diego may impose its own requirement and the managing agent has been asked to confirm.
The absence of an immediate threat should not be read as an absence of urgency. The condition that will produce a threat at this property is already present — a 22-year-old coating failing at the wall interface — and the interval between an unremedied coating failure and structural decay in this construction type is measured in a few years, not in a cycle. The board was briefed to this effect at its meeting of 9 April 2026, and the finding at unit 2-104 was described to the managing agent by email on 7 April 2026, the day it was found, rather than held for the report.
Incorporation into the Reserve Study
The following components should be carried in the association's reserve study, with the remaining lives stated in this report: balcony traffic coating, 30 elements, remaining useful life 0 to 2 years, scope being full recoat with wall-interface and penetration detailing; balcony structures, 30 elements, remaining useful life in excess of 25 years, with no funded replacement in the current study horizon; guardrail assemblies, 30 elements, remaining useful life 15 to 20 years; exterior stair stringers, 6 systems, 12 to 18 years; stair treads and nosings, 8 to 10 years; podium terrace membrane, building 3, remaining useful life 0 years.
Two adjustments to the association's current assumptions follow from this inspection. First, the reserve study dated 2023 carries 'balconies' as a single component with a 30-year life and a replacement scope. That treatment funds a structural replacement that this inspection finds is not needed for at least 25 years, while funding no recoat at all — the expenditure that is actually due now. The component should be split into coating and structure, on the lives given above. Second, sealant at guardrail penetrations should be moved out of reserves and into the operating budget as a recurring maintenance item; it is too small and too frequent to fund as a reserve component, and it has been missed precisely because it sits in neither budget at present.
This report should be provided to the association's reserve study preparer as the source for the lives above. Civil Code section 5551(f) requires that it be incorporated into the study required by Civil Code section 5550, and section 5551(i) requires all written reports to be maintained for two inspection cycles as records of the association — on a nine-year cycle that is eighteen years, so the 2026 report is retained until the 2044 inspection is complete. Since SB 410 (Chapter 516, Statutes of 2025) amended Civil Code sections 4525, 4528, 5200 and 5210, the most recent report is also an inspectable association record and must be provided to prospective purchasers, so the managing agent should hold it with the documents assembled for resale disclosure rather than in the engineering file.
Inspector Qualifications and Signature
K. Adeyemi, licensed structural engineer, State of California, licence S-XXXX, in good standing at the date of this report. Civil Code section 5551(b)(1) requires this inspection to be conducted by a licensed structural or civil engineer or architect; the qualifying basis here is licensure as a structural engineer, and the inspector holds no contractual or ownership interest in the association or in any contractor likely to bid the work recommended above.
Standard of care and limitations. The inspection was a reasonably competent and diligent visual inspection to the standard set by section 5551(b)(1), supplemented by probing, moisture readings and the three invasive openings described at Appendix C. Conditions concealed behind finishes, and conditions outside those three openings, were not observed and are not reported on. The service lives given in this report are professional projections for these assemblies in this exposure and are not guarantees; they assume the maintenance stated alongside each of them, and they will not hold if that maintenance is not performed. This report is stamped and signed below and dated 24 April 2026, as Civil Code section 5551(f) requires.
Section-by-section guide
What each section is for, what a good one contains, and where they typically go wrong.
1.Association and Inspection Details
Association name, property, number of units, the elements within scope, the inspection dates, and the inspecting professional with licence. Identify the governing provision as Civil Code 5551 explicitly — boards receive documents from many vendors, and the citation is what lets a manager file it correctly.
2.The Random List and the Statistically Significant Sample
The method section, and the one the apartment template cannot be copied into. Civil Code 5551(b)(1) calls for a visual inspection of a random and statistically significant sample of the exterior elevated elements for which the association has maintenance or repair responsibility, and 5551(a)(4) defines the sample size: enough units to give 95 percent confidence that the sample results are reflective of the whole, with a margin of error no greater than plus or minus 5 percent. Show how you got there. State the population of each type, the sample size the confidence and margin produce, and the number actually inspected. Then record the list mechanism from 5551(c), (d) and (h): before the first inspection the inspector generates a random list of the locations of each type of element covering all elements the association is responsible for, provides it to the association, and inspects in accordance with it; each subsequent inspection commences with the next element on the list and proceeds in order through it. The list is what makes the nine-year cycle cumulative rather than repetitive, so it belongs in the report and in the association's records, not in the inspector's file alone.
3.Photographs and Testing
Indexed and keyed to element identifiers, as for the apartment report. Where testing was performed, give the method, date and conditions. Civil Code 5551 does not enumerate photographs the way Health & Safety Code 17973(c)(4) does, but the report is the baseline the next inspection nine years from now will be compared against, and a nine-year gap is a long time to rely on adjectives.
4.Load-Bearing Components and Waterproofing System
Civil Code 5551(e)(1) asks first for identification of the building components that comprise the load-bearing components and the associated waterproofing system. Answer it as identification, not as condition: what the elements are made of and how they are built, element type by element type. It reads like preamble and it is not — it is what fixes the meaning of every condition statement that follows, and it is what a later engineer needs in order to know whether they are looking at the same assembly you were.
5.Current Physical Condition, Including Immediate Threat
Civil Code 5551(e)(2) asks for the current physical condition of those components, including whether it presents an immediate threat to the health and safety of the residents. The immediate-threat determination sits inside this requirement rather than beside it, so answer it here and answer it explicitly, including when the answer is none. Write the condition narrative to serve two readers: the board, who need to know what is wrong, and the next inspector, who needs a baseline to compare against.
6.Expected Future Performance and Remaining Useful Life
Civil Code 5551(e)(3) asks for the expected future performance and remaining useful life of the components — and it is the section the reserve study consumes. Give remaining useful life per element type with the basis, and separate the life of the waterproofing system from the life of the structure it protects. They are different numbers on different funding cycles, and conflating them is what produces a reserve plan that funds a replacement decades early and a recoat not at all.
7.Recommendations for Repair or Replacement
Civil Code 5551(e)(4) asks for recommendations of any necessary repair or replacement. Give them in priority order with an indication of scale. Boards are choosing between items in a budget, so an unranked list is not decision-ready, and a recommendation with no sense of magnitude is a decision deferred.
8.First-Page Disclosures and Inspector Certification
Civil Code 5551(e)(5), added by SB 410 (Chapter 516, Statutes of 2025), requires seven specific items to appear ON THE FIRST PAGE of the report: (A) the date of inspection; (B) the total number of units in the condominium project; (C) the total number of units with exterior elevated elements; (D) the total number of exterior elevated elements in the project; (E) the total number inspected; (F) as of the inspection date, the total number of inspected elements identified as posing an immediate threat to occupant safety and the number of units impacted; and (G) a certification that the inspector conducted a visual inspection and evaluated a statistically significant sample of the elements as required by subdivision (b). It appears here because it is item (5) in the statute's own list, and it is printed first because the statute says first page. Item (G) is not boilerplate — it is the inspector certifying the sampling method described above, so it cannot be signed unless that method was actually followed.
9.Delivery, and Emergency Measures Where a Threat Is Found
Civil Code 5551(f) requires the report to be stamped or signed by the inspector and presented to the board. It sets no fixed number of days for a routine report — unlike Health & Safety Code 17973(c)(4)'s 45 days, there is simply no day-count in this section for the ordinary case, and stating one would be inventing it. The only deadline in 5551 is triggered by an immediate threat: under 5551(g)(1) the inspector provides a copy to the association immediately upon completion of the report and to the local code enforcement agency within 15 days of completion of the report, and the association must then immediately take preventive measures including preventing occupant access until repairs have been inspected and approved by the local enforcement agency. Record what was delivered, to whom and when, and where a threat was found, what was communicated on the day.
10.Incorporation into the Reserve Study
Civil Code 5551(f) requires this report to be incorporated into the study required by Civil Code 5550 — the association's reserve study. State plainly which components belong in that study, with the remaining life and replacement scope for each, and identify anything that is an operating expense rather than a reserve item. Naming that boundary is the most useful paragraph in the report for a board and costs the inspector very little. Note also that 5551(i) requires all written reports to be maintained for two inspection cycles as records of the association, and that since SB 410 amended Civil Code 4525, 4528, 5200 and 5210, the most recent report is an inspectable association record that must be given to prospective purchasers.
11.Inspector Qualifications and Signature
Licence class and number, stamp, signature and date, plus a statement of the standard of care and the limits of a visual inspection. Civil Code 5551(b)(1) sets the standard the inspection itself is measured against — a reasonably competent and diligent visual inspection — and naming it is more useful to a later reader than a generic disclaimer. Section 5551(f) requires the report to be stamped or signed, so this is a statutory item rather than a formality.
Common mistakes
The failure modes that show up most often when this document is reviewed later.
Writing the report as a safety memo and leaving the reserve study to guess.
Section 5551(f) requires the inspection results to be incorporated into the reserve study required by section 5550, and section 5551(i) requires the inspection to be coordinated with that study's own inspection. A report that gives conditions without remaining lives forces the reserve preparer to invent the numbers the engineer was standing there to determine.
Carrying 'balconies' as a single reserve component.
The coating and the structure have different lives by a factor of two or more. Funding one component funds the wrong thing: a structural replacement decades early, and no recoat at all, which is how the structural replacement eventually becomes necessary.
Using the apartment statute's qualification rules.
Civil Code 5551(b)(1) requires a licensed structural or civil engineer or architect. The contractor and certified-building-inspector routes available under Health & Safety Code 17973 are not available for condominium projects. Note also that the civil engineer route is recent — it was added by AB 2114, Chapter 100, Statutes of 2024, an urgency measure effective on chaptering, so guidance written before mid-2024 names only structural engineers and architects.
Carrying the apartment statute's 15 percent sample into a condominium report.
There is no percentage in Civil Code 5551. It requires a random and statistically significant sample, defined at 5551(a)(4) as enough units to give 95 percent confidence with a margin of error no greater than plus or minus 5 percent. At small projects that drives the sample close to a census, so an inspector who inspects 15 percent of a 36-element project and calls it compliant has applied the wrong statute and under-inspected by a wide margin.
Treating the random list as the inspector's working paper.
Sections 5551(c), (d) and (h) make it an instrument of the nine-year cycle: it is generated before the first inspection, given to the association, and each later inspection commences with the next element on it and proceeds in order. An association that does not hold the list cannot tell its next inspector where to start, and the cumulative coverage the mechanism is designed to produce is lost.
Omitting the first-page disclosures, or signing the certification without having sampled.
Section 5551(e)(5), added by SB 410 (Chapter 516, Statutes of 2025), puts seven specific items on the first page, ending at (G) with a certification that the inspector evaluated a statistically significant sample as required by subdivision (b). A report that buries those figures in an appendix does not comply, and a certification signed over a convenience sample is a signed statement about a method that was not used.
Reporting 'no immediate threat' as though it means no urgency.
It answers a specific statutory question about today. A board that reads it as reassurance will defer the recoat, and the deferral is what produces the threat at the next inspection.
Ignoring elements outside statutory scope that are visibly failing.
A concrete podium terrace is not an exterior elevated element under the statute, but if it is leaking into occupied units the board needs to know. Report it, and label clearly that it sits outside the statutory scope.
Questions
- How does SB 326 differ from SB 721?
- SB 326 is Civil Code 5551 and applies to condominium projects; SB 721 is Health & Safety Code 17973 and applies to apartment buildings. Four differences change the report. Qualification: 5551(b)(1) allows only a licensed structural or civil engineer or architect, where 17973(a) also allows an A, B or C-5 contractor with five years' multistory wood-frame experience or a certified building inspector. Sampling: 5551 requires a random, statistically significant sample at 95 percent confidence and ±5 percent margin per 5551(a)(4), where 17973(c)(2) sets a flat minimum of 15 percent of each type. Cycle: 5551(i) required the first inspection by 1 January 2025 and then every nine years, in coordination with the reserve study under Civil Code 5550, where 17973(d)(1) required the first by 1 January 2026 and then every six years. Output: 5551(f) requires the report to be incorporated into the association's reserve study.
- What is the deadline and how often does it repeat?
- Civil Code 5551(i): the first inspection was to be completed by 1 January 2025, and then every nine years thereafter, in coordination with the reserve study inspection under Civil Code 5550. That deadline was never extended — AB 2579 in 2024 extended the apartment deadline in Health & Safety Code 17973 by a year and did not touch this section. For condominium buildings whose building permit application was submitted on or after 1 January 2020, 5551(k) requires the inspection no later than six years after the certificate of occupancy issues, which is a six-year first window on a nine-year recurring cycle.
- Who receives the report, and by when?
- Civil Code 5551(f) requires the report to be stamped or signed by the inspector and presented to the board, and incorporated into the reserve study required by Civil Code 5550. The section sets no number of days for a routine report — there is no condominium equivalent of the apartment statute's 45 days, and anyone quoting one is importing it from Health & Safety Code 17973. The only deadline in 5551 is triggered by an immediate threat: under 5551(g)(1) the inspector provides a copy to the association immediately upon completion of the report and to the local code enforcement agency within 15 days of completion of the report, and the association must then immediately take preventive measures including preventing occupant access until repairs have been inspected and approved by the local enforcement agency. There is otherwise no routine filing with a local agency, though 5551(n) permits stricter local requirements — check the jurisdiction.
- What has to appear on the first page?
- Seven items, under Civil Code 5551(e)(5), added by SB 410 (Chapter 516, Statutes of 2025): (A) the date of inspection; (B) the total number of units in the condominium project; (C) the total number of units with exterior elevated elements; (D) the total number of exterior elevated elements in the project; (E) the total number inspected; (F) as of the date of inspection, the total number of inspected elements identified as posing an immediate threat to occupant safety and the number of units impacted; and (G) a certification that the inspector conducted a visual inspection and evaluated a statistically significant sample as required by subdivision (b). The same bill narrowed 5551(l) so the section applies to buildings containing three or more ATTACHED multifamily dwelling units.
- Does Civil Code 5551 set a repair deadline?
- No. Unlike Health & Safety Code 17973(h), which gives an apartment owner 120 days to apply for a permit and 120 days after approval to complete the work, section 5551 contains no repair timetable. Its only repair-adjacent obligation is the immediate preventive-measures duty at 5551(g)(1) where a threat is found, plus the general ongoing maintenance duty at 5551(j)(2) as required by the association's governing documents. Secondary sources sometimes import the apartment timelines into the condominium context; they are not in this section.
- Does the association have to act on the recommendations?
- The board governs, and this report is professional advice rather than an order. But the findings feed the reserve study, and a board that receives a documented remaining life of zero to two years on a waterproofing system and funds nothing has made a decision it will be asked about later.
- What if some balconies are owner-maintained under the CC&Rs?
- Say so in the report and identify which findings fall on which side of that boundary. The inspection covers the elements; the governing documents decide who pays, and a board cannot act on a finding without knowing which budget it belongs to.
